The following conditions apply to the use of the LIFE4DOGS websites. In order to use the websites, it is important that you, as a user, accept the following terms and conditions.

By using our websites, you agree to the terms and conditions of use of our websites. By agreeing, you guarantee that you will not create, copy and/or read any content that violates the terms and conditions of use.

• The purpose of life4dogs.org is as follows: Users can submit incidents on the website, which are published after being checked and translated.
• The purpose for visitors to the app.life4dogs.org website is as follows: Users can view adoption ads from animal shelters and organizations on the website and send a message to the responsible animal shelter or organization.
• The purpose of app.life4dogs.org for animal shelters and organizations is as follows: At the aforementioned website, animal shelters and organizations can manage animals and use a digitalized animal management system with various functions free of charge.

§ 2.1 Processing and use of personal data

When a user (website visitor) fills out a form on the LIFE4DOGS websites, we rely on legitimate interest under GDPR Art. 6 para. 1 for data processing and use of personal data. The data will only be passed on to third parties if there is a necessity to do so, such as to the hosting provider. Under no circumstances will personal data be passed on commercially or used to sell products or services.

• Video recordings (Bodycam & Dashcam):
  With reference to “Legitimate Interest” Art. 6 para. 1 – DSGVO as well as BOE-A-2018-16673 Art. 22, we create recordings of our operations (e.g. patrol or rescue & recovery operations) in the course of our activities. The recordings are used primarily to protect people and animals. Furthermore, we may use some videos for marketing purposes (publications). We edit all videos so that no personal data or aspects (e.g. names, faces, license plates or similar) can be recognized in the videos. The recordings are generally deleted after 24 hours and the recordings for marketing purposes are stored separately and are not accessible to third parties. We do everything in our power to ensure that no recordings are passed on to third parties, with the following exceptions:
  1. The recordings are used to investigate a criminal offense in which individuals are potentially endangered while performing an activity for LIFE4DOGS and/or animals under the supervision of LIFE4DOGS.
  2. A court order has been issued.
  3. The judicial authority seizes the recordings based on the regular applicable laws.
• Incident reports:
  The data of the reporter will only be passed on in the course of a court order in the course of a case investigation by an authority.

• Messages:
  Messages from a website visitor that are forwarded to an animal shelter or organization are stored in full in our database for security reasons.

• E-mails:
  When a website visitor enters their personal data in a form, in particular their first and last name and email address, LIFE4DOGS uses this personal data for possible notifications. These may include, but are not limited to, the following:

1. 1. reports on rescued animals
   2. fundraising campaigns
   3. articles on animal welfare
   4. relief efforts by LIFE4DOGS or cooperating animal shelters and organizations.

§ 3 Availability of the websites

LIFE4DOGS and existing subdomains are available 24 hours a day. However, interruptions to availability may occur due to system maintenance. Availability interruptions may also occur due to force majeure or other causes beyond the control of LIFE4DOGS, such as willful misconduct or gross negligence.

LIFE4DOGS points out:

• that it is technically impossible to provide the websites free of errors of any kind and that life4dogs.org and existing subdomains therefore do not assume any responsibility for this,
• that errors can lead to the temporary shutdown of the website,
• that the availability of these websites depends on conditions and services outside the control of LIFE4DOGS, such as transmission capacities and telephone connections between the individual parties involved. We are not responsible for malfunctions in this area.

We will communicate with you electronically in a variety of ways, such as by email, text message, or by posting electronic messages or other communications on our websites or through other LIFE4DOGS services. For contractual purposes, you consent to receive electronic communications from us and that all consents, notifications, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, unless a different form of communication is required by applicable law.

• All content included on or provided by a LIFE4DOGS service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is property of LIFE4DOGS or third parties who supply content or make it available on the websites and is protected by European copyright and database law and may not be copied, duplicated or reconstructed.
• The entire content contained in or provided by a LIFE4DOGS service is also the exclusive property of LIFE4DOGS and is protected by European copyright and database law and may not be copied, reproduced or reconstructed.
• You may not systematically extract and/or re-utilize parts of the content and/or entire areas of the LIFE4DOGS websites without our express written consent. In particular, you may not use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilization of any substantial parts of any of the service of LIFE4DOGS, without LIFE4DOGS’s express written consent. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, and in the event of a legal dispute, the place of jurisdiction of LIFE4DOGS shall apply.

§ 13 Final Clauses

The ineffectiveness of one clause does not affect the effectiveness of the other clauses in the terms of use. Should this occur, the clause should be replaced by another legally permissible clause that corresponds to the meaning and purpose of the ineffective clause.
